Extract from sealed noterial copy of a document headed "Mr. H. E. F-l cone's Statement", dated "ovember 11th, 1922, signed by H. E. Falcone and countersigned by the Clerk of the United States Court for China, Shanghai.
"It was discovered that the market was flooded with "01 Mil)" oigarettes, which were slightly discolored, and that 98 a consequence asles were dropping off considerably. Upon investigating, we found that practically all the stock which was sent from Shanghai some months back had become discolored. This matter was reported and it was decided that: we take up all the old stock on the market and replace it with fresh stock. It ms about this time that !r. Theyken and myself discussed the possiblity of disposing of a faw of the cigarettes for our own profit. I asmred Fr. Theyken that it could be done safely and without fear of discovery. I approached man in the Custome, whom I understand was named J. Cassin, and explained to him my plan. Upon being sssured of his support, I interviewed Cheung Sing and Shun Kee with the aid of my interpreter, Mr. Peu, with a view to sell them a mæber of cigarettes which were to be reported as destroved. To further enable me to carry out my plans, I talked with the stevetore who was then handing our shipments, Mr. Chan of Wah Hing Co., who also sasured me that he would give me his support for a consideration, I then gave instructions to prepared the necessary papers required to destroy sixty 50,000 cases of cigarettes. The stevedore went to the Yeumati godown and took delivery of the sixty 50,000 csees and delivered thirty of the cases to the destroyal grounde, fifteen cases to Cheung Sing and fifteen onzes to Shun Kee; in the meantime having discovered
